Settlement

This page explains how there is no right to apply to live permanently in the UK (known as 'settlement' or 'indefinite leave to remain') if you are here under Tier 5 of the points-based system, except if you applied to enter the UK as a private servant in a diplomatic household before 6 April 2012. If you entered the UK as a private servant in a diplomatic household on or after 6 April 2012, you cannot apply for settlement.

The time you spend in the UK under all other Tier 5 categories will not count towards any settlement you may apply for in the future.

In order to apply for settlement as a Tier 5 (International agreement) migrant who is a private servant in a diplomatic household who applied to enter the UK in that category before 6 April 2012, you must have been in the UK for a continuous period of 5 years under that category.

During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months. The absences must be for a reason that relates to the purpose of your leave in the UK, or for a serious or compelling reason (such as serious illness). Your sponsor must confirm the reason for the absence if it was related to your work. You must confirm the reason for the absence for any other serious or compelling reason.

You must have sufficient English language ability and knowledge of life in the UK, unless you are under 18 years old or over 65 years old when you apply. You can find more information in the Settlement section.
