Dependants

This page explains what documentary proof dependants (spouses or civil partners, migrant's unmarried or same-sex partner or migrant's child) must provide of their available maintenance (funds) to support an application for leave to remain as the dependant of someone who is here under the post-study worker category (Tier 1 Post-study work) of the points-based system to work in the United Kingdom.

The evidence provided can relate specifically to the dependant or it can also include evidence for the main applicant which has not been used as evidence of funds on the main applicant's own application or that of other dependants.

Dependants must send one or a combination of the following.

Transitional arrangements for maintenance

Normally, when applying from inside the United Kingdom, if main applicant under the post-study worker category is outside the United Kingdom or has been in the United Kingdom for less than 12 months, the family member must show that the main applicant or the dependant has at least £1,600 to support the dependant as well as the funds needed to support the main applicant.

If the main applicant has been present in the United Kingdom for 12 months or more, the main applicant or the family member of the post-study worker must have £533 to support himself/herself.

Because this is a new requirement and it may be difficult to prove this immediately, we have put transitional arrangements in place for you and your family members submitting your applications within the United Kingdom up to and including 31 October 2008.

Up to 31 October 2008, you do not have to show you have had the funds for at least three months before your application. You must only show you have the required funds at the time you apply. Until 31 October 2008, your supporting evidence does not need to cover the three-month period, but the documents must be dated no more than a month before your application.

For example, if you apply under the post-study worker category on 12 July, a single bank statement with a closing balance of £800 dated between 12 June and 12 July will meet the maintenance requirements. A bank statement dated before 12 June will not be acceptable.

For applications submitted within the United Kingdom on or after 1 November 2008, and for applications submitted in countries overseas, you will have to meet the requirements below.

Personal bank or building society statements covering the previous three-month period

The personal bank or building society statements should clearly show:

  • the name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom; 
  • the account number; 
  • the date of the statement; 
  • the financial institution's name and logo; 
  • transactions covering the three-month period; and
  • that there are enough funds present in the account for the past three months; and 

If you wish to send electronic bank statements from an online account these must contain all of the details listed above. You must also send a supporting letter from your bank, on company headed paper, confirming the authenticity of the statements provided.

We will not accept statements which simply show the balance in the account on a particular day as these documents do not show that you hold enough funds for the full period required.

Building society passbook

The building society passbook should clearly show:

  • the name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • the account number; 
  • the financial institution's name and logo;
  • transactions covering the three-month period;
  • that enough funds have been present in the account for the past three months.

Letter from bank confirming funds and that they have been in bank for at least the previous three months

The letter from a bank or building society should state:

  • the name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • the account number;
  • the date of the letter;
  • the financial institution's name and logo;
  • the funds held in the applicant's account; and
  • that the funds have been in bank for at least three months and are at least the amount needed.

We will not accept letters which simply show the balance in the account on a particular day as these documents do not show that you hold enough funds for the full period required.

Letter from a financial institution regulated by the Financial Conduct Authority (FCA) and Prudential Regulation Authority (PRA)confirming funds

The letter from a financial institution regulated by the FCA/PRA should state:

  • the name of the main applicant and/or the family member making the application, or (for children only) the name of their other parent who is also legally present in the United Kingdom;
  • the account number;
  • the date of the letter;
  • the financial institution's name and logo;
  • the funds held in your account; and
  • that the funds have been in bank for at least three months and are at least the amount needed.

We will not accept letters which simply show the balance in the account on a particular day as these documents do not show that you hold enough funds for the full period required.
