A highly skilled migrant reviewing their application

Refusals

This section explains how you can appeal against our decision if we have refused your application under Tier 1 (General) of the points-based system.

If you applied from inside the UK

If you applied from inside the UK, you may have a statutory right of appeal.

If we refuse your application, we will write to you giving our reasons and explaining what you can do. If you have a right of appeal, we will give you full details of your rights and an appeal form which you can complete and return.

If you applied from outside the UK

If you applied from outside the UK, you have a right to an administrative review, which is free of charge. See the appeals page for further information.

You must request a review of the refusal within 28 calendar days of the date the refusal notice was issued.

You can only ask for one administrative review for each application that we refuse. You should not send any additional documents with your request for a review.
