This page explains what requirements an employment or recruitment agency must meet to apply to sponsor migrants under the points-based system.
Employment agencies can only sponsor migrants who will work within their own organisation. We will not grant a licence if you intend to supply sponsored migrants to a third party as labour, regardless of any contractual agreement between the parties concerned.
If you are a sponsor that wants to employ a migrant worker who has been supplied to you by an employment agency or business, you can only assign a certificate of sponsorship (CoS) if you:
- have full responsibility for deciding the duties, functions and outcomes, or outputs of the job the migrant is doing; and
- are responsible for agreeing and paying the migrant's salary.
